WV v. EPA: Tangible Takeaways

After the significant U.S. Supreme Court case on June 30, 2022, A&WMA invited an expert group of panelists to discuss the immediate effects and implications of WV v. EPA.

Guest speakers will feature West Virginia Solicitor General Lindsay See, who presented oral argument before the Court on behalf of 20 states; Eugene Trisko, who serves as Clean Air Act (CAA) and international Air Quality Counsel to United Mine Workers of America (UMWA), Electrical Workers and Boilermakers; Kathy Beckett, who serves as counsel to CAA regulated sources to include the Midwest Ozone Group; and Brian Bunger, environmental attorney in the San Francisco Bay Area, and recently retired after nearly 20 years as Counsel for the Bay Area Air Quality Management District.

This panel with explore key principles of law such as justiciability, major questions, agency deference and impact on regulation of GHG sources. Discussion will include assessment of states’ rights to regulate sources of GHGs independent of federal CAA regulation. The format for this unique event will be an interactive discussion, accompanied by summary slides, with opportunity for audience questions.
